1. General provisionsBy ordering work, you automatically agree to all the terms of this document. Please read it carefully before placing an order. I reserve the right to refuse an order without giving any reason.
2. Payment1. 50% prepayment — before starting work. Full payment — before sending the final file or work.
2. Accepted payment methods: [Monobank, Privatbank, Payoneer, IBAN, etc.]
3. Prices are fixed at the time of order confirmation.
4. Complex orders may have an additional fee — discussed individually.
3. Deadlines1. Estimated deadlines are discussed before the work begins and depend on the complexity.
2. If you need the work by a certain date, let me know in advance.
3. Urgency may incur an additional charge
4. I will report on progress and delays if they occur.
4. Working process
After agreeing on the details, I send the sketch for approval.
Up to 2 rounds of edits are included at the sketch stage. Additional edits after approval are paid.
After the start of the cleanup, significant changes are not possible - traditional techniques do not allow "ctrl+Z".
The client is obliged to provide all necessary references and information before the start.
5. Delivery of the original
The original is sent after full payment.
The cost and method of delivery are on the client's side or discussed separately.
I pack the works with high quality, but I am not responsible for damage during shipping. I recommend insuring the parcel.
A digital scan of the work is provided in any case.
6. Cancellation and refund

Circumstances under which funds are not refunded1. Approved sketch. After the client has confirmed the sketch in writing and the work has moved to the finishing stage - the prepayment is non-refundable regardless of the reason for the cancellation.
2. Completed or partially completed work. If the cancellation is received during the finishing stage - the payment is charged in proportion to the volume performed. If the work is fully completed - there is no refund.
3. Received work. After the original or digital file has been sent to the client - the funds are non-refundable under any circumstances.
4. Change of preferences. "I don't like it anymore", "I changed my mind", "I want a different style" - are not grounds for a return after the work has begun.
5. Failure to provide references or feedback. If the client does not provide the necessary information within the specified time and the work is delayed or canceled - the prepayment is non-refundable.
6. Violation of the ToS terms by the client. If it is found that the client has violated the terms (use in AI, modification, unauthorized commercial use) - returns are excluded, and I reserve the right to take further measures.
7. Dissatisfaction with the style. The artist's style is public and known at the time of the order.
8. Disagreement with the style of execution after the work is completed is not a reason for a return.
9. In controversial or exceptional situations, I am ready to consider the issue individually - but this is my right, not an obligation.
Partial refund1. Only possible if cancellation occurs during active cleanup and the amount of work completed is less than 50%.
2. The amount is determined by me based on the actual time and materials spent.
3. Partial refunds are the exception, not standard practice.
7. Copyright1. I retain copyright to all works — including the right to publish them in a portfolio, social networks, exhibitions.
2. The client receives personal use: printout, publication with attribution, gift.
3. Commercial use (sale, advertising, merch) — separate agreement and additional payment.
4. It is forbidden to remove the signature or pass off the work as your own.
8. Prohibition of use in artificial intelligence1. It is strictly forbidden to use any works (originals, scans, WIP images, sketches) for training, pre-training or fine-tuning any artificial intelligence models - both free and commercial.
2. It is forbidden to upload works to datasets, databases or platforms where they can be used for AI training (Midjourney, Stable Diffusion, DALL·E, Leonardo, etc.).
3. It is forbidden to use works as a reference or prompt for generating new images through AI tools.
4. This restriction applies to the client, as well as to any third parties to whom the client provides access to the work.
5. Violation of this clause is considered a gross violation of copyright and may have legal consequences.
9. Prohibition of modification1. It is forbidden to make any physical changes to the original work without the written consent of the author (redrawing, coloring, cutting, editing, etc.).
2. It is forbidden to digitally modify a scan or photo of the work: apply filters, change colors, crop the author's signature, combine with other images.
3. Any derivative work created based on my work requires separate permission and agreement.
4. Publishing edited versions without permission is a violation of copyright.

11. Liability and force majeureI am not responsible for delays caused by force majeure (illness, power outage, martial law, etc.). In such cases, I notify the client and offer a solution: extension of the deadline or refund.
